By downloading, installing, accessing, or using the Medita mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you and Vargas Studio Ltd ("we," "us," or "our").
Medita is a meditation and wellness mobile application that provides: guided meditation sessions; meditation programs and playlists; progress tracking and statistics; free and premium content.
The App does not require an account or sign-in. You use the App with a local identity on your device only. All data (favorites, progress, preferences) is stored on your device and is not linked to any account. The App is available for iOS devices and may be updated from time to time.
Plan Esencia (Free): Access to free meditation content. Plan Trascendencia (Premium): Access to all meditation content and premium features.
All payments are processed by Apple through the App Store. Subscription fees are charged to your Apple ID account. Prices are displayed in your local currency. We do not process payments directly and do not have access to your payment information.
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage and cancel auto-renewal in iOS Settings → [Your Name] → Subscriptions.
You can cancel your subscription at any time through iOS Settings. Cancellation takes effect at the end of the current billing period. You keep access to premium content until then. No refunds are provided for the current billing period.
Refund requests must be submitted to Apple. We do not process refunds directly. Refunds are subject to Apple's refund policy.
We may change subscription prices; changes will be communicated in advance. Continued use after a price change constitutes acceptance.
Free trials may be offered; terms will be stated at sign-up. If you do not cancel before the trial ends, you will be charged for the subscription.
All content in the App is owned by Vargas Studio Ltd or its licensors and is protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to access and use the App for personal, non-commercial purposes, to download and listen to meditation content for personal use, and to create playlists for personal use. You may NOT copy, reproduce, or distribute App content; use it for commercial purposes; reverse engineer the App; remove copyright notices; share the App or your subscription in violation of these Terms; or use the App in violation of applicable laws.
You agree to use the App only for lawful purposes, respect intellectual property rights, not interfere with or disrupt the App or servers, not attempt unauthorized access, not use automated systems to access the App, and not transmit viruses, malware, or harmful code.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF CONTENT. We do not warrant that the App will be uninterrupted or error-free, that defects will be corrected, or that the App is free of viruses or harmful components.
IMPORTANT: Medita provides meditation and wellness content for informational and educational purposes only. The App is NOT a substitute for professional medical advice, diagnosis, or treatment. You should consult a qualified healthcare provider before starting any meditation or wellness program, seek immediate medical attention if you experience health issues, and not rely on the App for medical or mental health treatment. We are not responsible for any health issues, decisions made based on App content, or consequences of using meditation techniques.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES; LOSS OF PROFITS, DATA, OR USE; PERSONAL INJURY OR PROPERTY DAMAGE; OR ANY DAMAGES ARISING FROM USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Vargas Studio Ltd, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of another party.
You may stop using the App at any time by uninstalling it from your device. If you have a subscription, you can cancel it at any time through iOS Settings; cancellation takes effect at the end of the current billing period. Refunds are handled by Apple (see section 4.5).
We may suspend or terminate your access to the App if you misuse it—for example, if you violate these Terms or engage in fraudulent or illegal activity.
If your access is terminated for misuse, your right to use the App ceases immediately and you will lose access to premium content (if applicable). We are not obligated to provide refunds for the remaining period.
We may update these Terms from time to time. We will update the "Last Updated" date; significant changes will be communicated through the App or via email; continued use after changes constitutes acceptance. If you do not agree to the changes, you must stop using the App.
These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to their conflict of law provisions. Disputes shall be resolved through good faith negotiation, mediation if needed, binding arbitration if needed, and courts of competent jurisdiction as a last resort.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Vargas Studio Ltd regarding your use of the App and supersede all prior agreements.
These Terms are provided in English and Spanish. In case of any conflict between the English and Spanish versions, the English version shall prevail.
By using Medita, you acknowledge that you have read and understood these Terms, agree to be bound by them, are at least 13 years old (or have parental consent), and will comply with all applicable laws and regulations.
By using Medita, you agree to these Terms of Service. If you do not agree, please do not use the App.
